Temporary Skill Shortage (TSS) Subclass 482 Visa

The Subclass 482 visa helps Australian employers fill critical skill gaps by allowing them to sponsor skilled workers from overseas. This temporary visa offers work rights for up to two or four years, depending on the selected stream. There are three streams under the 482 visa:

Short-Term Stream: For occupations on the Short-Term Skilled Occupation List (STSOL). This stream allows a stay of up to two years. Visa holders may extend their stay to four years if an International Trade Obligation applies. After working two years on a 482 visa, they can pursue permanent residency through the ENS Subclass 186 Visa.
Medium-Term Stream: For occupations on the Medium and Long-Term Strategic Skills List (MLTSSL),. This stream allows a stay of up to four years. After working in Australia for two years on a 482 visa, holders can pursue PR via ENS Subclass 186 Visa.
Labour Agreement Stream: For occupations under a labour agreement between the Australian government and an employer. This stream also allows for permanent residency pathways through the ENS 186 visa.

Employer Nomination Scheme (ENS) Subclass 186 Visa

The Subclass 186 Employer Nomination Scheme (ENS) visa allows Australian employers to sponsor skilled workers from overseas for permanent residency. This visa is designed to address long-term skill shortages. It is available under three streams depending on the worker’s qualifications and employment history. This visa has three streams:

Direct Entry Stream: For applicants have work experience of three years. This stream is suitable for individuals who meet the skills and qualifications for their nominated occupation without needing prior experience on a 482 visa.
Temporary Residence Transition (TRT) Stream: This is the most common pathway for 482 visa holders. After working for their employer for at least two years on a 482 visa, applicants can transition to permanent residency through the 186 visa TRT stream.
Labour Agreement Stream: Similar to the 482 visa Labour Agreement Stream, this is for workers employed under a labour agreement.

Key Features of 186 visas:

Eligibility: Requires an approved occupation, employer nomination, and meeting the work experience or skills assessment criteria.
Visa Duration: Permanent residency.
Permanent Residency Pathway: Immediate upon visa approval under the Direct Entry Stream or through the Temporary Residence Transition Stream. Transition after working for the same employer on a 482 visa for at least three years.
